Fair Use Policy

ZENYT_FUP_REV_2026.07

This Fair Use Policy ("FUP") outlines the terms of acceptable, safe, and responsible use of VPS, dedicated servers, and game server solutions provided by ZenytCloud. The FUP is designed to prevent the abuse of shared physical hardware resources and to protect the network stability of our autonomous system (AS200282).

1. Hardware Monitoring & Resource Management

SYS_HW_01

We continuously monitor node-level statistics to verify resource load. No automated resource limits are applied, but manual interventions occur on severe abuse:

Shared CPU/RAM Peak Allowed Time Max 4 Hours continuous @ 100%
Dedicated Server Hardware Usage Uncapped (100% allowed)
Shared Disk I/O Saturation Prohibited if affecting host I/O

Disk I/O Limitations: Continuous, intensive I/O operations (such as unoptimized database transactions, persistent local backup tasks, or raw file processing) that cause node-wide disk latency bottlenecks are prohibited. VPS or game nodes causing disk degradation are subject to suspension.

Pre-Approved Heavy Workloads: If you plan to execute legitimate CPU-intensive routines that exceed a 4-hour continuous limit, you must open a support ticket prior to execution to receive authorization from our systems staff.

2. Prohibited Software & Activities

BAN_02

The execution of unauthorized tools is strictly prohibited across all network segments (including dedicated servers):

BLOCK_DAEMON_ALERT // EGRESS_RULES
[-] CRYPTO_MINING: Monero (XMR), Bitcoin (BTC), Ethereum (ETH), or Chia storage farming blocks are blocked globally.
[-] PORT_SCANNING: Nmap, Nessus, brute-force injection scripts, or network vulnerability scanners.

* Authorized vulnerability self-tests require a pre-dispatched support ticket and explicit written authorization from systems staff.

3. Network, Bandwidth & VPN Usage

NET_03

Bandwidth & Traffic: Bandwidth and monthly transfer allowances are unlimited by default, unless capped on specific custom resource limits. However, deliberate traffic congestion or network pipeline exhaustion designed to saturate physical host uplinks is strictly prohibited.

Port 25 (SMTP): Egress SMTP Port 25 is open by default. The Client retains full liability for all email traffic. If our network detects outbound Spam operations, or receives spam reports, Port 25 or the entire instance will be locked instantly.

VPN & Proxy Nodes: Setting up private VPNs (e.g., WireGuard, OpenVPN) or custom proxy configurations is allowed. However, all incoming and outgoing traffic remains under the civil and criminal liability of the Client. ZenytCloud does not monitor internal VM traffic; the Client responds directly under legal subpoenas for their assigned IP addresses.

4. Guidelines for Game Servers (Pterodactyl)

GAME_04

Internal Mechanics: ZenytCloud does not intervene in in-game administration, lag machines (e.g., inside Minecraft), exploit loops, or virtual asset duplications created by players. These items are the sole responsibility of the game server administrator.

Staff Intervention: Staff will only intervene if game instances run out-of-bounds loops that saturate shared node resources (e.g., RAM memory leaks or multi-core CPU clamping) as defined in Section 1.A.

EULA & Botting: Client is responsible for complying with game developer EULAs. Botting, fake player farming, or server spoofing that violates network stability or developer policies is subject to cancellation upon official reports.

5. Copyright & Peer-to-Peer (P2P)

DMCA_05

P2P Protocols: Running Torrent or Peer-to-Peer clients is permitted strictly for legitimate and legal transfers (e.g., distributing custom client files or downloading public open-source software like Linux ISOs).

Copyright Violation: Hosting, transferring, or downloading copyrighted materials without holding explicit legal rights is strictly prohibited. Received DMCA warnings or copyright infringement reports will trigger immediate service suspension.

6. Collaboration with Authorities & Abuse

LAWS_06

Abuse Reports: Upon receiving verified reports of malicious activity (such as hacking attempts, phishing endpoints, malware, or outbound floods), the Client must resolve the issue or isolate the target container within 12 hours of email/ticket receipt.

Law Enforcement Cooperation: CIMAX Technologies LLC and ZenytCloud actively cooperate with state and federal law enforcement agencies in Wyoming (USA) and the European Union. In compliance with our Privacy Policy, under valid court subpoenas, we will share all account information, including IP authentication logs, billing records, and metadata.

7. Sanctions & Escalation Procedure

ENFORCE_07

In case of FUP violations, ZenytCloud will implement a tiered escalation process depending on the severity:

STAGE 01
Standard Warning

Minor FUP issues (e.g. accidental CPU peaks). A ticket notification is opened, giving the client an optimization window.

STAGE 02
Service Suspension

Repeated resource bottlenecks or ignored warning tickets. The service is suspended manually until resolved via billing support.

STAGE 03
Immediate Purge

Critical violations (crypto mining, outbound DDoS, phishing, billing fraud). The service is terminated instantly without refund or data recovery.
